Two men, 38 and 41 years old, have been sentenced to thirteen and a half years in prison by the Provincial Court of Zamora for sexually assaulting a thirteen-year-old girl She was taken to property and forced to perform sexual practices against her will.
One of the defendants had a long-standing friendship with the minor – who is now 16 years old – to the point that the latter had been at least twice at the former’s home. He also provided her with his phone number and called her regularly and they saw each other, being aware that they were a couple, according to the sentence provided by the Superior Court of Justice of Castilla y León.
In July 2018, they met after he told her on the phone to go to the garage to talk more calmly, she agreed to accompany him. Once there, the second was also involved. Then, the ruling considers proven that between the two, grabbing her by the arms, they forced her into the rear of the vehicle placing one on each side and forcing her, despite the fact that she told them she did not want to, to perform fellatio on them. They then left the place, not before warning her not to tell anyone about what happened.
Days later the two defendants met with her on the street and began to argue about what had happened days before, making one of them made a gesture with the hand, -wash the hand around the neck-, of «clear meaningAt the same time they cornered her against a car parked there, and pushed her against it. These events were observed by the girl’s friends who were in the vicinity and who saw what was happening, approached them and told her to go with them and the incident ended. The friends accompanied the adolescent to her mother’s workplace, where they told her what had happened, and the complaint process began.
The Chamber considers both authors a crime of sexual assault on a person under the age of sixteens for which he condemns them to thirteen years and six months of deprivation of liberty and to a fine of 360 euros for another abuse. In addition, a compensation of five thousand euros is established and the prohibition of approaching less than half a kilometer or communicating with the victim is imposed for a period of 18 years and six months.
