Díaz reactivates the repeal of the labor reform and employers reaffirm their rejection

The negotiation that must be resolved between now and the end of the year on future of labor regulations In Spain, it started with a meeting this morning in which a distance between the parties was once again evident that, to this day, seems very difficult to bridge. The “labor revolution” announced by Díaz has thus resumed after the summer break without there having been any notable approaches or major changes in the approach neither by the Government, nor by the unions or employers.

After the meeting, the greatest optimism has been felt in the ministry of Yolanda Diaz. Work sources assure that “many proposals and alternatives around the topics of debate” have been raised at the meeting and they point out that there has been the “active participation of all parties” as well as “the determination to move forward and meet loosely European commitments’.

Among entrepreneurs, however, the mood is not so positive. Sources close to the CEOE assure that the Government has focused on the last document that was raised before the summer and that it includes several “unacceptable” aspects. Before the summer, the employers had already categorically rejected the proposal put forward by Labor and in fact they recall that they did not rule out the possibility of denouncing changes to Brussels that they consider to go against what the Commission claims.

The unions, for their part, are still waiting for the decision that the President of the Government makes regarding the minimum interprofessional wage, since they have already advanced that they will not accept an aesthetic measure. In addition, the meeting or disagreement in this matter threatens to also determine their position in other negotiating tables such as the labor market.

The Government seeks to simplify the types of contracts with the idea of ​​reducing them to three, giving the permanent one the absolute preference over the rest, an aspect that the CEOE rejects considering that it will be a stumbling block for certain productive activities. Employers defend that temporality is an intrinsic element of many seasonal activities, so reducing it «harms the employability of many people, especially those who lack qualifications and young people, at a time when their employment rate unemployment is around 40%, and even exceeds 50% in many territories.

Another matter to be negotiated will be the design of the new model of permanent ERTE, the conditions of the subcontractors or the rebalancing of collective bargaining, in which we also start from very distant positions.

The marathon of negotiations will continue tomorrow, with the negotiation to define what will be the future of the ERTEs that were activated in the pandemic as of September 30, when their validity expires. The little margin in negotiation is precisely one of the points that both employers and unions have liked the least. Currently there are about 260,000 workers still covered by an ERTE, a figure very far from the 3.6 million that it protected at the worst moment of the pandemic, but who belong to the most affected sectors.
